Confetti Dogs TERMS & CONDITIONS

Welcome to our Confetti Dogs website! These Terms and Conditions (“Terms”) govern your use of our website, www.confettidogs.com, and all products, services, and features available on the website (the “Site”). By accessing or using the Site, signing up for our training services, and other features, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Site and you should not use our services.

 

1. Use of the Website

  • You agree to use the Site only for lawful purposes and in accordance with these Terms.
  • You agree not to use the Site to engage in any activity that could damage, disable, overburden, or impair the Site, or interfere with any other party’s use of the Site.

2. Account Registration

  • Some areas of the Site may require you to create an account or provide personal information. You agree to provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

3. Service & Product Information & Orders

  • Confetti Dogs makes every effort to display accurate service and product information, including descriptions, prices, and availability. However, we do not guarantee that all information is error-free.
  • All paid for services, products purchases, orders placed through the Site are subject to acceptance. We reserve the right to refuse or cancel any order at our discretion.
  • Prices for services and products are subject to change without notice. Any pricing or product discrepancies will be corrected as soon as possible.

4. Payment & Billing

  • All payments for services & products & other features are processed securely through third-party payment processors. By submitting an order or by making a payment on a service, you authorize Confetti Dogs to charge the payment method you provide for the total cost of your order.
  • You agree to provide accurate and complete payment information when making a purchase. Any issues with payment processing are your responsibility.

 

5. Confetti Dogs Guarantee & Refund Policy

  • We are happy to provide refunds according to our Confetti Dogs Guarantee & Refund policy as described below. Please review this section for eligibility criteria.
  • Confetti Dogs cannot guarantee that your dog will make the right decisions all the time…no trainer can guarantee that. However, if by the end of our program (assuming you have worked through the HW drills, sent 3-4 short videos each week, actively participated in the training sessions, asked for help during the weeks of training, via WhatsApp, text, phone calls, emails, etc…) if you are not satisfied with the results and/or do not feel like you have a good plan / trajectory with your dog moving forward — only after adding 3-4 more sessions for free and actively participating in these additional free sessions — then all money will be refunded to you within 2 months (minus the cost of any provided training supplies, as well as estimated gas money based on mileage and the amount of trips).

 

6. Intellectual Property

  • All content on the Site, including but not limited to text, graphics, logos, images, videos, and software, is the property of Confetti Dogs or its licensors and is protected by copyright and trademark laws.
  • You may not use, copy, modify, or distribute any content from the Site without express permission from Confetti Dogs.

 

7. Waiver of Liability (Site & Purchases)

  • Confetti Dogs is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any products or services purchased from the Site or via any third parties being utilized in conjunction with Confetti Dogs payments / purchases / services.

8. Dog Training Services Waiver of Liability / Informed Consent Intro

  • When you pay for / purchase a service, product, membership, or feature AND / OR when you willingly enroll in, sign up for, accept & participate willingly in a free service and/or practice any free training advice / suggestions offered by Confetti Dogs, LLC, you are agreeing to the “Terms”, the Privacy Policy, and even more specifically, you are agreeing to the Confetti Dogs, LLC Waiver of Liability / Informed Consent  as delineated below in “Terms #9”. 
  • The Confetti Dogs, LLC Waiver of Liability / Informed Consent  (in “Terms #9” below) applies to all In-Person / In-Home Training Services & Programs, all Virtual Training Services & Programs, and all Hybrid Training Services & Programs, Any and All Training / Coaching Services, Other Services, and Any Products, Memberships, or Features Offered, as well as Any Time Before, During, Between, and After Any Service Provided by Confetti Dogs, LLC. Again, the Confetti Dogs, LLC Waiver of Liability also applies to any paid for services and/or free services.
    • Clarity of Definition as follows: 
  1. “In-Person / In-Home Training Services & Programs” – This category includes any training sessions that involve meeting in person with the client’s dog(s) or to discuss the client’s dog(s) and working with the dog(s) in a hands-on, in-person method. In-Home / In-Person refers to any location that is applicable to the established training goals and the needs of the dog(s). It is not limited to the client’s actual home.
  2. “Virtual Training Services & Programs” – This category includes any training sessions completed over third party services such as Zoom, Google Meet, FaceTime, WhatsApp, and other similar apps & services, as well as any training suggestions & rehearsal, etc…during Phone Calls or via voicemail, or via email messages / text messages / WhatsApp messages, social media messages & comments, and other third party services that are similar in nature. 
  3. “Hybrid Training Services & Programs” – This category refers to a mixture or blend of #1 & #2 above whether sessions be alternating or varied according to the clients goals and their dog’s needs.
  4. “Any and All Training / Coaching Services, Other Services, and Any Products, Memberships, or Features offered” – This category refers to anything and everything beyond #1,2,and 3…offered on the Site or anywhere Confetti Dogs is digitally, virtually, or physically present.
  5. “Any Time Before, During, Between, and After Any Service Provided” – This category refers to any time, occurrences, events, training sessions, HW tasks, client’s practice / rehearsal with their dog(s),  daily life activities and experiences, etc…that occur as stated: any time Before, During, Between, and After Any Service Provided  (Paid or Free)

 

9. Dog Training Services Waiver of Liability / Informed Consent

I hereby acknowledge that I am voluntarily participating in Dog Training and any applicable services, features, products, etc…with Confetti Dogs, LLC and I represent that I am at least eighteen years of age. I have enrolled myself and my dog(s) in dog training, private consultations, workshops, or other related activities and/or classes offered by Confetti Dogs, LLC. I am aware that this includes a variety of services / programs as listed below and is defined in Terms #8: 

  1. “In-Person / In-Home Training Services & Programs”
  2. “Virtual Training Services & Programs”
  3. “Hybrid Training Services & Programs”
  4. “Any and All Training / Coaching Services, Other Services, and Any Products, Memberships, or Features offered”
  5. “Any Time Before, During, Between, and After Any Service Provided”

Confetti Dogs, LLC will exercise all necessary and proper care and precautions to keep all participants and dogs safe during training sessions in order to prevent injury to any person, property, dog, or other dog or person. However, because dogs are animals and may be unpredictable, and additionally may find themselves in unpredictable situations, Confetti Dogs, LLC cannot protect against every potential injury, risk, or accident. This Release and Waiver are intended to shift the risk of participating in dog training to the Participant/Owner/Guardian of the dog participating in training. I acknowledge that I am aware as I read this, that I am welcome to discuss any and all concerns I have regarding foregoing risks with Confetti Dogs, LLC and its authorized representatives before participating in any training program of any sorts with Confetti Dogs, LLC.

I agree to hold harmless Confetti Dogs, LLC from any and all claims of injury, loss, cost, expenses, or damage caused by actions of my dog during the course of training, training sessions, or under the care, custody, or control of Confetti Dogs, LLC. I hereby accept and assume, without reservation, all risks associated with my participation in the training program, including, but not limited to: the risks of any and all injuries to myself, my dog, and any of my family members or third parties who may attend; the risks that my dog may cause injury to other persons and/or dogs involved; the risks that there may be other dogs present whether intentionally or unexpectedly during training or between sessions and that these dogs could be off-leash intentionally or unexpectedly or on-leash but could do damage to my own dog(s), and the risks that saliva, water, food, toys, and/or other debris may be present in the training area(s). I have read and understand Confetti Dogs, LLC’s Training Plan Proposal designed specifically for my dog(s) where training goals / focuses / training priorities and various approaches are outlined…but I also understand that during the course of this personalized program, which by its own nature, must be adaptable as we are attempting to meet the training and safety needs of each dog and participant, that sometimes changes in the training plan/approach may occur as each dog and each particular circumstance. I understand that the trainer will be communicative, informative, and educational about the various processes / strategies / approaches that we use as we are actively supporting my dog(s) training needs. 

As lawful consideration for participating in the training program, I, for myself, my heirs, next of kin, executors, administrators, legal representatives, successors, and assigns (the “Releasing Party”), hereby waive, release, discharge and covenant not to sue and to indemnify, defend and hold harmless Confetti Dogs, LLC and their members, managers, agents, and employees (the “Released Party”) from any and all injuries, losses, claims and damages to any person or persons of any nature its directors, officers, employees, agents, sponsors, organizers, volunteers, or other representatives, their successors and/or assigns, (hereinafter collectively the “Releases”) from any and all liability to the Undersigned for any loss, harm, damage, claim, injury or accident to the person or property of the Undersigned, whether caused by any ordinary negligent act during or between sessions or by the omission of the Releases while the Undersigned or his/her dog is engaged and/or participating in dog training or using any Trainer or Business facilities in connection therewith, and any location as aligned with my Personalized Training Program in connection therewith.

This Waiver of Liability & Informed Consent Release shall be legally binding on the Releasing Party. Further, should the Releasing Party assert a claim to the contrary of what I have agreed to in this Waiver of Liability and Informed Consent Release, the claiming party shall be liable for all expenses (including attorney’s fees, court costs and consultant fees) incurred by both the Releasing Party and the Released Party. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and the Releasing Party. 

Every provision herein is intended to be severable. If any one or more of the provisions herein is found to be unenforceable or invalid, that shall not affect the other terms and provisions hereof, which shall remain binding and enforceable. This foregoing release and waiver, and assumption of risk is intended to be as expansive, broad, and inclusive as permitted by Maryland law. I also represent that I am at least eighteen years of age.

Before, during and after training service: Confetti Dogs, LLC cannot guarantee that the dog will respond adequately to commands at all times and/or respond appropriately in all situations. The owner agrees that Confetti Dogs, LLC will not be liable for any damage or loss resulting from the dog’s failure to respond to any command(s) or behavior modification for which Confetti Dogs, LLC has trained the dog and worked with the client on. By signing this agreement, the owner agrees to these terms for all animals and humans you allow to participate in the actual training sessions, in between sessions during everyday life, and all the animals and humans who are directly or indirectly involved or present in the dog’s life in one way or another whether before our actual training program begins, during our actual training program, during its sessions, in between sessions, during HW practice / skill rehearsal, during long term support, during group classes, and throughout the life of the dog.

 

10.  Photo / Video / Audio / Written CONSENT

The information below is applicable only if I have chosen to sign up for and purchase a Confetti Dogs, LLC Training / Coaching Program of any sorts.

I hereby consent to my dog and myself, as well as actively involved friends / family / neighbors to being the subject of photographs and/or audiovisual recording and authorize Confetti Dogs, LLC to cause the same to be exhibited for educational purposes for other clients with similar challenges, and/or for educating other canine professionals, and/or the larger community via Social Media, online courses, etc…and/or for marketing tools and educational content as still photographs, video, or other similar media. I consent to the photo / video / audiovisual content being used during the length of our program, into Long Term Support, and beyond at any point in the future. I am aware that Confetti Dogs, LLC often finds it helpful, when supporting other Confetti Dogs clients, or the larger community of dog owners / pet parents (via Social Media, or Online Training, etc…to share videos / photos that may be beneficial to their particular situations/training plans/goals, etc… I hereby consent for photos / videos to be taken during our weeks of training, whether in-person or virtual (examples:  screen recording, virtual session  recordings, or screen shots of Zoom / Google Meet  sessions or similar third party apps / services, and during Long Term Support sessions and/or Group Classes. I also hereby give my consent to also include videos and/or photos that I send Confetti Dogs, LLC via email, texting / SMS, WhatsApp or other means, for my homework protocols, etc. Often, Confetti Dogs, LLC and its employees will ask specific and direct permission prior to using any videos / photos / messages, etc…for the purposes mentioned above in this paragraph (social media, marketing, education, etc…) but will not always remember to do so nor have time to do so prior to utilizing the item. However, to clarify, by signing this agreement, I do understand and agree to it, that regardless of whether or not John or any Confetti Dogs, LLC employee asks me directly for specific permission/consent prior to using said photos / videos / audiovisual content, written reviews or content, etc. that I am consenting here regardless.

11.  Expectations on Client Engagement

The information below is applicable only if I have chosen to sign up for and purchase a Confetti Dogs, LLC Training / Coaching Program of any sorts.

I understand that Confetti Dogs, LLC will continue to provide training services to the client according to our agreed upon training program, whether an in-person, virtual, or hybrid program, for as long as they ask for ongoing support within the term length of the plan. I understand it is the client’s responsibility to communicate to the trainer as needed for scheduling questions/concerns, reschedule missed training sessions, seek out help as needed in order to reschedule, schedule optional Long Term Support sessions, etc. If the client has not scheduled a weekly session for 4 weeks or more without any communication with the trainer, the program, including all long-term support AND access to group classes, will terminate and no refunds will be given. Again, because this is the client who is seeking support and coaching, and it is the client’s dog who is in need of training, support, coaching, and/or behavior modification, it is the client’s responsibility to take initiative with the scheduling of all weekly sessions using the scheduling link(s) provided by Confetti Dogs, LLC. Likewise, it is the client’s responsibility to communicate to the trainer when scheduling challenges arise or if last minute changes need to be made, etc. I, the undersigned, understand that the scheduling link provided in the “Welcome To Your Confetti Dogs Training Program” email or via text message or WhatsApp or any other means, is the one that the client will need to use perpetually throughout the program. In addition, I understand that by the nature of this personalized training program, that it is very specifically my responsibility to help myself and my dog reach training goals each week and throughout the program, by committing to the various homework tasks as delineated by the trainer, recording and uploading 3-4 videos each week via WhatsApp, initiating communication throughout the week when I am confused about something, am having trouble, am dealing with safety concerns in the context of my dog(s), or need help with something, etc. I understand that it is my responsibility to send 3-4 adequate videos of my practice with my dog(s) each week and to communicate with the trainer when questions arise during my practice. “Adequate” videos… meaning: videos that are 2-5 minutes in length that are actually demonstrating the drills / concepts that are delineated in each week’s HW assignments. If a week has gone by without any adequate videos being sent, I understand that the next session may be canceled depending upon the needs of the dog. Furthermore, if I send ALL of my 3-4 videos only within 24 hours or less before the next scheduled session, that session may be rescheduled depending on the needs of the dog. If a cancellation/rescheduling (as a result of HW videos not being sent) occurs three times during the course of the program, the program, including all long-term support AND access to group classes, will terminate and no refunds will be given. Even if I am in communication with the trainer off and on, but am having to continue cancelling / rescheduling sessions…if 1 month has passed without having completed a session…the program, including all long-term support AND access to group classes, will terminate and no refunds will be given. If I create a pattern of sessions very spread out (beyond the 7-14 days between sessions) without an informally documented agreement (text, message, email, audio clip, video response), then the program, including all long-term support AND access to group classes, will terminate and no refunds will be given. The expectation is to schedule sessions 7-14 days apart as a norm. I understand, as does Confetti Dogs, LLC, that, of course, there are nuanced and unexpected circumstances (death in the family, sickness in the family, unexpected work related scenarios, severe weather, etc…) that may call for unique scheduling procedures / HW procedures, and flexibility to the humanness of the situation, etc… but as for the norm, I agree to the terms communicated in this “Expectations” Section.

I understand that the reason Confetti Dogs, LLC’s programs have a high potential to be successful and create great trajectories for many dogs moving forward for many dogs is due, not only to the commitment of Confetti Dogs, LLC and its employees, but even more so due to the proactive and documented engagement of the client. It is my responsibility to schedule my weekly sessions. It is my responsibility to ask questions when I am confused about something in a lesson or in my Homework tasks, it is my responsibility to maintain contact with my trainer when needed throughout the program. It is my responsibility to show evidence of my efforts (3-4 HW videos each week, text messages / WhatsApp messages / emails to communicate progress, etc…). It is my responsibility to read over or listen to the audio clips, watch videos of the various HW tasks, and set aside some time each day (usually 15-20 minutes) for highly intentional & thoughtful rehearsal of the skills / concepts being developed based on the guidance of my dog’s trainer.

 

12.  Confetti Dogs Training Plan Proposal or “TPP” Agreement (if applicable)

The information below is applicable only if I have chosen to sign up for and purchase a Confetti Dogs, LLC Training / Coaching Program of any sorts.

CONFETTI DOGS TRAINING PLAN PROPOSAL (TPP) AGREEMENT:

By signing today, I am also confirming here, that I have received, read over, and agree to the Training Plan Proposal (TPP) that was sent to me by Confetti Dogs, LLC.

I understand that, although there may be many different things in everyday life that my dog needs help with or things my dog and I need to work on…the personalized program was designed to focus on the training priorities / goals that I have communicated in the Eval Questionnaire, or via texts, emails, etc…as well as what I have communicated to the trainer at the free in-home evaluation or free zoom evaluation, etc.

I understand, for example, that if my personalized TPP was designed with the priorities of working through Leash Reactivity / Leash Walking & Socialization in City Parks or Downtown (for example), then I understand we will not be spending our time developing a completely different skill like off-leash reliability or working through separation anxiety. Likewise if my main goal / training priority that I communicated was “off-leash reliability” (for example), then I cannot expect the trainer to focus on Leash Aggression / Leash Reactivity concerns during our Lesson Plans or Long Term Support Sessions, etc. I understand and agree to the actual Training Priorities as listed and described on the TPP that I received. I also understand that Confetti Dogs, LLC programs are customized according to the needs of the dog and the goals of the client…so it is absolutely possible and common that there would be more than one Priority on any given plan, but that I am agreeing to the focus in our training being on the dog(s) listed in TPP and the various Priorities listed in the TPP. 

To further clarify…these priorities (as listed on the TPP) align with what I have communicated to the trainer and what we have discussed. I am fully aware that I can, and am welcome to, reach out with any questions of clarity or if I wish to change or modify anything on the plan or its specific Priorities that are delineated there. Beyond the Training Priorities listed on the TPP, I also agree to all of the other sections that were included in the document (Supplies Provided, Long Term Support, Amount of Sessions, etc…).

 

13.  Client Responsibilities (if applicable)

The information below is applicable only if I have chosen to sign up for and purchase a Confetti Dogs, LLC Training / Coaching Program of any sorts.

  • I am aware of and agree to do my best with the Client Responsibilities as listed below.

1) Make every effort to use training supplies only as directed by the trainer. 

2) Make a time commitment of at least 15-25 minutes of training (broken up in smaller sessions throughout the day if needed) for at least 4-5 days a week during our program.

3) Record & send 3-4 short videos each week showing your efforts on the homework tasks designed by the trainer. Videos should be from 2-5 minutes long.

4) Be committed to asking questions via WhatsApp / Text / Email, etc…when you need help or clarity about something you are working on with your dog.

5) Schedule each of our sessions 7-14 days apart, but communicate if there needs to be a change in scheduling or a unique circumstance is causing delay in scheduling or if you need to schedule a little earlier. *Consistency is key to laying a great foundation for the future. 

6) Stay committed to being a problem-solver and being adaptable as a dog owner/guardian always seeking to figure out new angles to affect positive change with your dog, especially, but not limited to, the term your particular program.

 

14.  Trainer Responsibilities

  • I am aware of the Trainer’s Responsibilities as listed below and I’m aware that my trainer will do his/her best 

1) Prepare excellent lessons each week that help us meet our training goals.

2) Provide clearly communicated homework assignments to support both the dog and the dog owner(s) via messages, pdf’s, videos, and/or audio clips, etc.

3) Offer client support through WhatsApp and/or Texting, etc… throughout each week.

4) Send helpful videos and messages throughout the process when needed so the client has something to support their efforts.

5) Give helpful feedback as needed and critique the client’s short HW videos they share on WhatsApp each week as needed.

6) Stay committed to being a problem-solver and being adaptable as a trainer…knowing full well that different dogs receive information differently and have many unique challenges, and require different energy, different communication, different engagement, different concepts, etc.

 

15. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of the state of Maryland, without regard to its conflict of law principles.
  • Any disputes arising out of or related to these Terms will be resolved through binding arbitration in Maryland, unless otherwise required by law.
